The duty to cooperate contains the procedural duties of prior information and of prior consultation. It could be said that these procedural duties of cooperation seek to ‘operationalise’ Article 5 – 7 of the UN Watercourses Convention (principles of ‘equitable and reasonable utilisation’ and ‘no significant harm’). Article 8(1) therefore provides the basis for many of the procedural rights and obligations contained primarily in parts III-VI of the UN Watercourse Convention. |
